01Acceptance and Eligibility

Age Requirements

You must be at least 13 years old to use Fit4Gains. Users aged 13–17 must have the consent and involvement of a parent or guardian.

Account Registration

Creating an account requires a valid email and a secure password. You agree to provide accurate information, keep it up to date, protect your credentials, and report any unauthorized access promptly.

Account Security

You are responsible for all activity under your account. We are not liable for losses arising from unauthorized access caused by your failure to safeguard your credentials.

02License and Service Access

License Grant

Subject to these Terms, Fit4Gains grants you a limited, non-exclusive, non-transferable, revocable license to install and use the app on devices you own for your personal, non-commercial use.

You may not resell, redistribute, create derivative works from, reverse engineer, or commercially exploit the service without our written authorization, or remove any proprietary notices.

Free and Premium Features

Some features are available for free, while others — such as advanced AI program generation, deeper analytics, and additional content — may require a paid subscription tier.

Service Modifications

We may modify, suspend, or discontinue features, impose usage limits, or restrict access. We will provide advance notice of material changes where reasonably feasible.

Beta Features

Features marked as beta or experimental may have limited functionality, may change or be removed without notice, and are used at your own risk.

03Acceptable Use Policy

Permitted Uses

• Plan, log, and track your own workouts and progress
• Generate training programs using the AI features
• Create custom exercises and manage favorites
• Export your personal activity data

Prohibited Uses

• Technical: Attempting unauthorized access, using automated tools without authorization, interfering with operation, reverse engineering, or overloading our infrastructure.
• Content: Uploading malicious code, posting false or misleading information, impersonating others, or infringing intellectual property rights.
• Behavioral: Harassing or threatening others, spamming, using the service for illegal activity, or creating fake accounts.
• Commercial: Unauthorized commercial use, reselling access, or scraping data for commercial purposes.

Enforcement

Violations may result in warnings, content removal, suspension or termination of your account, loss of premium access, or legal action.

04User-Generated Content

Your Content

You retain ownership of the content you create, including your profile information, progress photos, custom exercises, notes, and logged data.

License to Fit4Gains

By submitting content, you grant Fit4Gains a worldwide, non-exclusive, royalty-free license to host, store, display, and process that content solely to operate and provide the service to you. This license ends when you delete the content, except to the extent it has already been shared or is required for backups or legal compliance.

Content Responsibility

You are solely responsible for the content you submit, including ensuring you have the rights to it and that it complies with applicable law and these Terms.

Content Removal

We may remove or restrict content that violates these Terms or applicable law. We are not obligated to monitor user content.

05AI-Generated Programs

Fit4Gains uses AI to generate workout programs and recommendations based on the inputs you provide. AI output is generated automatically and may contain inaccuracies or be unsuitable for your circumstances.

AI-generated plans are suggestions, not professional advice. You are responsible for reviewing any program and exercising within your ability.

We do not guarantee any particular fitness result. You should consult a qualified professional before starting or changing an exercise program.

06Third-Party Services and Integrations

Fit4Gains relies on and integrates with third-party services. These operate under their own terms and privacy policies, may have limitations, and may change or become unavailable.

• Infrastructure: Google Cloud Platform and Supabase for hosting, data, and storage.
• AI: Google Vertex AI / Gemini for program generation.
• Health integrations: Apple Health and Google Fit, when you choose to connect them.
• Payments: Apple App Store and Google Play for in-app purchases.

We are not responsible for the failures, errors, content, or data practices of third-party services.

07Payment Terms

Subscriptions

Premium subscriptions are offered on monthly or annual billing cycles and renew automatically unless cancelled. Prices may change with notice. A free trial may be offered and will convert to a paid subscription unless cancelled before it ends.

Billing

Subscriptions are billed through the App Store or Google Play. You authorize recurring charges to your selected payment method until you cancel.

Cancellation and Refunds

You can cancel anytime through your App Store or Google Play account; access continues through the end of the current billing period. Refunds are governed by the App Store and Google Play refund policies. Partial-period refunds are generally not provided.

08Intellectual Property Rights

All intellectual property in Fit4Gains — including software, designs, graphics, logos, trademarks, exercise media, and databases — is owned by Fit4Gains or its licensors and protected by applicable laws.

The "Fit4Gains" name and logo are trademarks and may not be used without written permission. You may not copy, reproduce, distribute, or create derivative works from the service except as expressly permitted.

Feedback

If you provide feedback or suggestions, we may use them without obligation, compensation, or attribution.

09Disclaimers

Fit4Gains is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Fitness Risks

Exercise carries inherent risks, including injury. Fit4Gains does not eliminate these risks. You assume all risks associated with your training.

No Professional Advice

Fit4Gains does not provide medical, nutritional, or professional coaching advice. Information in the app is for general informational purposes only. Consult a qualified professional before acting on it.

No Guarantee of Accuracy

We do not warrant that analytics, metrics, AI output, or other information will be accurate, complete, or uninterrupted.

10Limitation of Liability

To the maximum extent permitted by law, Fit4Gains and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, or for loss of profits, data, or use.

Fit4Gains is not liable for injuries, health outcomes, or decisions made based on information or AI output provided by the service.

Maximum Liability

To the extent liability cannot be excluded, our total liability for any claim is limited to the greater of the amount you paid us in the preceding 12 months or USD $100.

Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits liability that cannot be excluded by law, such as for death or personal injury caused by negligence.

11Indemnification

You agree to indemnify and hold harmless Fit4Gains, its affiliates, and their officers, employees, and agents from any claims, liabilities, damages, and expenses arising from your use or misuse of the service, your violation of these Terms or applicable law, your content, or your training decisions.

12Dispute Resolution

Informal Resolution

Before filing any claim, please contact us at legal@fit4gains.app describing the dispute and your desired resolution, and allow a reasonable period (at least 30 days) for us to resolve it informally. Most disputes can be resolved this way.

Governing Law

These Terms are governed by the laws of the jurisdiction in which Fit4Gains is established, without regard to conflict-of-law principles. Mandatory consumer-protection rights in your country of residence are unaffected.

13Termination

By You

You may stop using Fit4Gains and delete your account at any time in the app settings. Deleting your account does not automatically cancel a paid subscription — cancel separately through the App Store or Google Play.

By Us

We may suspend or terminate your account for violations of these Terms, fraudulent or illegal activity, or to protect users or the service.

Effect of Termination

Upon termination, your license to use the service ends, and your data is handled in accordance with our Privacy Policy. Provisions that by their nature should survive termination — including content licenses, intellectual property, disclaimers, liability limits, and indemnification — will continue to apply.

14General Provisions

• Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Fit4Gains.
• Changes to terms: We may modify these Terms; material changes will be notified, and minor changes posted with an updated "Last updated" date.
• Severability: If any provision is unenforceable, the remaining provisions remain in effect.
• Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Waiver: Our failure to enforce a provision is not a waiver of our right to do so later.

15App Store Terms

For downloads from the Apple App Store or Google Play, these Terms are between you and Fit4Gains, not Apple or Google. Those platforms have no obligation to provide support for the service and are not responsible for it. Apple is a third-party beneficiary of these Terms and may enforce them.
